Announcement by TS Wisła Kraków S.A.
Application for suspension of proceedings and stay of execution of the decision regarding the match between Śląsk Wrocław and Wisła Kraków on March 7, 2026.
Acting on behalf of Towarzystwo Sportowe Wisła Kraków Spółka Akcyjna, with its registered office and address in Krakow (30-059) at ul. Reymonta 20, entered into the Register of Entrepreneurs of the National Court Register under number: 0000130748, NIP: 6771022149, whose registration files are kept by the District Court for Kraków-Śródmieście in Krakow, XI Commercial Division of the National Court Register, with a share capital of PLN 89,162,300.00 (paid in full), e-mail address: sekretariat@wislakrakow.com (hereinafter referred to as the "Club" or "Wisła Kraków"), as the President of the Club's Management Board, authorized for sole representation, in connection with the proceedings conducted by the Esteemed Commission regarding the match of the 24th round of the 1st League Championship competition in the 2025/2026 season between the first teams of Wisła Kraków and WKS Śląsk Wrocław S.A. (hereinafter referred to as "Śląsk Wrocław") on March 7, 2026 (hereinafter referred to as the "Match"),
I request:
1. Suspension of the proceedings conducted by the Esteemed Commission regarding the Match until the final conclusion of the disciplinary proceedings conducted by the PZPN Disciplinary Commission against Śląsk Wrocław regarding the refusal to accept an authorized group of Wisła Kraków fans for the Match,
2. Suspension of the issuance of any decision by the Esteemed Commission in this matter until the final conclusion of the disciplinary proceedings conducted by the PZPN Disciplinary Commission as indicated in point 1 above. At the same time, I indicate that on March 12, 2026, the first meeting of the PZPN Disciplinary Commission in the aforementioned case took place, and the next meeting was scheduled for March 16, 2026 (Monday) at 2:00 PM.
JUSTIFICATION
The matter being the subject of these proceedings is complex and multi-faceted, and its essence remains closely related to disciplinary accusations that are currently the subject of proceedings conducted by the PZPN Disciplinary Commission. These proceedings primarily concern the decision of the Śląsk Wrocław authorities to refuse to accept an organized group of Wisła Kraków fans, as well as the circumstances accompanying this decision, including a potential violation of fair play rules, organizational standards applicable in competitions conducted under the auspices of the Polish Football Association, and the principles of procedural loyalty between participants in the competitions.
The proceedings conducted by the PZPN Disciplinary Commission concern circumstances that are directly related to the events preceding the Match, in particular the decision of the Śląsk Wrocław authorities to refuse to accept an organized group of Wisła Kraków fans and the manner in which it was made. The findings made in these proceedings will therefore be of key importance for assessing the overall situation that led to the non-appearance of the Wisła Kraków first team at the Match. Issuing a decision by the Esteemed Commission before the conclusion of the disciplinary proceedings would in practice lead to prejudging findings that are currently being examined by the PZPN Disciplinary Commission.
Such a course of action would be contrary to the principle of fair proceedings and the elementary standards of the correct sequence of dealing with cases by union bodies. In particular, it should be noted that the factual circumstances that are the subject of the disciplinary proceedings are directly related to the reasons that led to the non-appearance of the Wisła Kraków team at the Match. At this point, I would like to emphasize that Wisła Kraków made genuine and multi-pronged attempts until the very end to resolve the dispute amicably, in accordance with the applicable regulations of the Polish Football Association and with respect for basic safety principles. The Club did not act abruptly, arbitrarily, or confrontationally, but remained engaged in discussions conducted both with the participation of representatives of the Polish Football Association and representatives of Śląsk Wrocław.
In particular, it should be noted that on February 25, 2026, a tripartite conversation took place between the President of the Management Board of Wisła Kraków - Mr. Jarosław Królewski, the President of the Polish Football Association - Mr. Cezary Kulesza, and the President of the Management Board of Śląsk Wrocław - Mr. Remigiusz Jezierski. This conversation was initiated to reach an agreement regarding the dispute concerning the rights of away fans (i.e., the authorized group of Wisła Kraków fans) and the organization of the Match between the two clubs. During the arrangements made, all involved parties - including the President of the Polish Football Association - unanimously agreed that on the following day, i.e., February 26, 2026, further talks aimed at reaching an agreement and finding a solution that would allow the Match to be held in accordance with the applicable PZPN regulations and safety principles would be continued.
This arrangement was unambiguous and constituted an element of the agreed procedure for further proceedings between the parties. From Wisła Kraków's perspective, the above arrangements were of significant organizational and negotiating importance, as they formed the basis for further dialogue with the participation of representatives of the Polish Football Association and justified the Club refraining from taking public and definitive actions until the planned talks were held. In this context, it is particularly important that the agreed procedure for further arrangements was unilaterally interrupted by Śląsk Wrocław the very next day. The talks scheduled for February 26, 2026, did not take place for reasons solely attributable to the organizer of the Match.
Śląsk Wrocław - without prior notice, contrary to the arrangements made, and disregarding the other participants in the talks - decided to publish a unilateral statement. This action, in practice, meant breaking off the agreed procedure for further negotiations and interrupting the process aimed at an amicable resolution of the dispute with the participation of representatives of the Polish Football Association.
At the same time, it should be emphasized that during the tripartite conversation on February 25, 2026, the President of the Management Board of Śląsk Wrocław explicitly declared that:
1. he was under pressure and being intimidated in connection with this matter,
2. decisions regarding the position of the Śląsk Wrocław authorities on the refusal to accept an organized group of Wisła Kraków fans were in fact made by fan groups, and not by the statutory bodies of the club,
3. he was considering resigning from his position as President of the Management Board of Śląsk Wrocław. These circumstances were extremely serious, as they concerned not only the background of the dispute itself, but above all the real ability of the Match organizer to make independent, autonomous, and responsible decisions regarding the organization of a mass event and ensuring the safety of its participants.
What is particularly important, all the above-mentioned circumstances - i.e., the issue of intimidation of the President of the Management Board of Śląsk Wrocław, the actual influence of fan circles on the decisions of the club authorities, and the considered resignation of President Jezierski - were subsequently publicly confirmed by the President of the Polish Football Association, Mr. Cezary Kulesza, who, on his own initiative, spoke about the course of these talks in the mass media. This circumstance is of particular evidentiary weight, as it comes from a person directly involved in the talks and holding the highest position in the structures of the Polish Football Association.
In light of the above, it should be concluded that on the part of Wisła Kraków, there were not only justified, but even serious and objectively verifiable doubts as to whether the organizational decisions on the part of the Śląsk Wrocław authorities were made autonomously, in accordance with the regulations, and providing any guarantees of safety for the players, coaching staff, and representatives of Wisła Kraków. If the President of the Management Board of the Match organizer himself indicated that he was under pressure, that he had no real decision-making power, and that the club's decisions were influenced by fan groups, it was not possible to reasonably assume that the safety of the Wisła Kraków delegation was organizationally and actually guaranteed.
Under these circumstances, the decision to send the Wisła Kraków team, coaching staff members, coaches, and other functional persons of Wisła Kraków to the Match in Wrocław became impossible. The safety of players, coaching staff members, and other persons working for the Club must be guaranteed in a real, consistent, and unquestionable manner. In the existing factual situation, such guarantees did not exist.
It should also be emphasized that Wisła Kraków made efforts until the last moment to clarify the situation amicably and in accordance with the applicable procedures. Only after exhausting available means of contact, due to the lack of a constructive response from the Śląsk Wrocław authorities and due to growing and unexplained doubts regarding safety, the Club - on March 4, 2026 - was forced to take a final stance.
The decision not to travel to Wrocław was therefore not an act of bad faith or a refusal to play the Match as such, but solely an action dictated by concern for the health, safety, and well-being of the players, coaching staff, and employees of Wisła Kraków. At the same time, Wisła Kraków appealed to the Polish Football Association for intervention and assistance in resolving the existing crisis, clearly signaling that it sought a solution in accordance with PZPN regulations and did not shy away from playing the Match, provided that it could take place under conditions compliant with union law and basic safety standards. Consequently, it should be stated that the findings of the PZPN Disciplinary Commission regarding the legality and legitimacy of the actions of the Śląsk Wrocław authorities constitute a key element for assessing all circumstances related to the Match.
For this reason, the Esteemed Commission's consideration of the case before the conclusion of the disciplinary proceedings would lead to a premature and potentially inconsistent decision with subsequent findings. The order resulting from the rules of proper procedure and a basic sense of justice require that the adjudicating bodies proceed in a sequence that takes into account the priority of hearing disciplinary charges.
